Refund policy

This Return and Refund Policy governs purchases made through https://www.metroshinestudio.company/ (“Website,” “Site,” or “Metro Shine Studio”), operated by CF ECHEVERRIA CAPITAL LLC (“CF ECHEVERRIA CAPITAL LLC,” “we,” “us,” or “our”).

Our tableware products are selected for customers who want practical and attractive pieces for everyday meals, entertaining, dining spaces, gatherings, and household use. Because cups, bowls, plates, and similar tableware may come into direct contact with food and beverages, our return procedures are designed to protect customers while also taking product condition, cleanliness, packaging integrity, and resaleability seriously.

Nothing in this Policy is intended to remove, limit, or waive any consumer right or remedy that cannot lawfully be excluded under applicable federal or Florida law.

1. Products Covered

This Policy applies to tableware and related products sold through the Website, including:

  • Cups;
  • Bowls;
  • Plates and dishes;
  • Similar dining or serving pieces that may be added to the Website from time to time.

Each product should be used according to its individual description, specifications, care instructions, and intended purpose.

2. Standard Return Period

Unless a different return period is expressly stated on a particular product page, customers may request a return within 30 calendar days after delivery.

The return period begins on the date the carrier records the package as delivered.

A voluntary return requested after this period may be declined unless the merchandise is defective, materially different from what was ordered, damaged in transit, or another remedy is required by applicable law.

3. Conditions for Voluntary Returns

A voluntary return may include a change of mind, duplicate purchase, incorrect selection, preference change, or purchase that is no longer needed.

For such a return, the merchandise should:

  • Be unused;
  • Be clean and free from food, beverage, grease, stains, odors, or other residue;
  • Remain in substantially its original condition;
  • Include original packaging where reasonably available;
  • Include labels, inserts, accessories, or other components supplied with the product;
  • Not have been altered, repaired, painted, engraved, or otherwise modified;
  • Not show substantial signs of use.

Customers may reasonably inspect merchandise after delivery. However, inspection should not become ordinary household use.

4. Food-Contact and Hygiene Considerations

Because cups, bowls, plates, and similar tableware may be intended for food or beverage contact, products that have been used may present cleanliness and resaleability concerns.

Unless otherwise required by applicable law, we may decline voluntary returns of merchandise that has been:

  • Used to serve food or beverages;
  • Washed or treated after use;
  • Exposed to food residue;
  • Exposed to oils, sauces, beverages, or other substances;
  • Stained or contaminated;
  • Returned with strong odors;
  • Returned in a condition that cannot reasonably be restored to saleable condition.

This provision does not eliminate remedies for defective, damaged, incorrectly supplied, or materially nonconforming merchandise.

5. Cups

Customers should inspect cups for size, shape, appearance, color, quantity, and general condition before use.

Once a cup has been used for drinking, washed, or exposed to food or beverages, it may no longer qualify for a voluntary change-of-mind return.

If a cup arrives cracked, chipped, broken, materially discolored, or otherwise defective, please contact us promptly.

6. Bowls

Bowls should be inspected before they are placed into normal household use.

A bowl that has been used for food service, washed, scratched through improper handling, stained, chipped, cracked, or otherwise altered may be excluded from voluntary return eligibility.

If the bowl arrives damaged or materially differs from the product ordered, please contact us with photographs and order information.

7. Plates and Dishes

Customers should inspect plates or dishes before use to confirm the expected size, design, quantity, and condition.

A plate or dish that has been used for meals, washed, stained, chipped, cracked, or otherwise exposed to household use may not qualify for a voluntary return.

This restriction does not affect any legally applicable remedy for defective or nonconforming merchandise.

8. Damaged Merchandise

If an item arrives damaged, please contact us as soon as reasonably practical.

For broken, cracked, chipped, shattered, or otherwise damaged tableware, please provide:

  1. Order number;
  2. Product name;
  3. Description of the damage;
  4. Photographs of the product;
  5. Photographs of the shipping box and internal packaging, if available.

Because fragile tableware can be affected by handling during transportation, photographs of both the merchandise and packaging can assist with determining what occurred.

Depending on the circumstances, we may offer:

  • Replacement merchandise;
  • A replacement for the affected quantity;
  • Partial refund;
  • Full refund for affected merchandise;
  • Another appropriate remedy.

9. Incorrect Item or Quantity

If your shipment contains the wrong product or incorrect quantity, contact us promptly.

Examples include:

  • Receiving bowls instead of cups;
  • Receiving a different plate design than ordered;
  • Receiving a different size or configuration;
  • Receiving fewer items than the quantity purchased.

We may request photographs of the received products, packaging, shipping label, or packing materials to help verify the fulfillment issue.

10. Defective or Nonconforming Merchandise

If a product arrives with a material defect or does not materially correspond to the description presented at the time of purchase, please contact us.

Depending on the circumstances, we may request photographs or other reasonable information to evaluate the issue.

Nothing in this Policy prevents a customer from exercising a right or remedy that applicable law requires us to honor.

13. Return Shipping Costs

For voluntary returns unrelated to defects, damage, or fulfillment errors, the customer may be responsible for return shipping costs.

When a return results from merchandise that was materially defective, incorrectly supplied, or damaged under circumstances for which we are responsible, we will review the situation and determine the appropriate shipping remedy.

14. Shipping Charges and Refunds

Our standard shipping structure is:

  • Free shipping for qualifying orders with a merchandise subtotal of $10 or more; and
  • $5.99 shipping for orders with a merchandise subtotal below $10.

Where a customer voluntarily returns merchandise, any applicable original shipping charge will be treated according to the reason for the return and applicable law.

15. Refund Processing

Once an approved return is received, the merchandise may be inspected to confirm its condition and eligibility.

Approved refunds will generally be issued to the original payment method.

18. Return Packaging

Customers returning fragile tableware should use reasonable packaging designed to protect the merchandise during transportation.

Where original protective packaging remains available, customers are encouraged to use it.

Damage occurring because merchandise was inadequately packaged for a customer-responsible return may affect the return evaluation.

19. Lost Return Shipments

If the customer is responsible for return shipping, the customer should retain tracking information and proof of shipment.

If a return cannot be confirmed as delivered, we may request carrier information before processing the refund, subject to applicable law.

20. Order Cancellation Before Shipment

If you wish to cancel an order before shipment, contact us promptly.

We will make reasonable efforts to stop orders that have not entered fulfillment. Once merchandise has been packed or transferred to a carrier, cancellation may no longer be operationally possible.

21. Delayed Orders

If an order cannot be shipped within the applicable promised period, we will follow applicable federal requirements concerning delay notices, customer consent, cancellation, and refunds.

The FTC's Internet-order rule generally requires a seller to have a reasonable basis for its shipment representations and provides cancellation/refund procedures when an order cannot be shipped on time.

22. Florida Consumer Protection

CF ECHEVERRIA CAPITAL LLC intends to conduct its consumer transactions consistently with applicable Florida law.

Florida Statutes §501.204 currently provides that unfair methods of competition, unconscionable acts or practices, and unfair or deceptive acts or practices in trade or commerce are unlawful.

Accordingly, this Policy is intended to be administered in a manner consistent with applicable Florida consumer-protection requirements.

23. Abuse Prevention

We may investigate unusually frequent or potentially fraudulent return activity, including fabricated damage claims, intentional product damage, repeated inconsistent claims, payment fraud, or misuse of refund procedures.

Any action taken under this section remains subject to applicable law.

24. Policy Changes

We may revise this Policy as products, fulfillment procedures, technology, or legal requirements change.

The version applicable to a purchase will generally be the version in effect when the order was placed, except where a later legal requirement must apply.
